A federal judge has dismissed a lawsuit by a German citizen who says U.S. agents mistakenly kidnapped him and sent him to a secret prison in Afghanistan. The man, Khaled El-Masri, alleges he was first detained while on vacation in Macedonia. Once in CIA custody he says he was repeatedly beaten, roughly interrogated by masked men, detained in squalid conditions and denied access to an attorney or his family. He was only released after the CIA realized they had detained the wrong man, and left him alone on an abandoned road in Albania. On Thursday, the judge ruled proceeding with El-Masri’s case would harm national security. Ben Wizner, an attorney with the American Civil Liberties Union who is representing al-Masri, said he will file an appeal. Wizner said: “[The ruling] confers a blank check on the CIA to shield even the most outrageous conduct from judicial review

Rice to Admit German's Abduction Was an Error
He has evidence. It would take a trial to determine if it is enough to prove his claims. Day in Court Denied for Victim of CIA Kidnapping and Rendition, Khaled El-Masri _____________________

read carefully...
"He was only released after the CIA realized they had detained the wrong man, and left him alone on an abandoned road in Albania."read carefully... "...why did the Justice Department suddenly drop its investigation of the warrantless spying on citizens because the NSA said Justice Department lawyers didn't have the necessary security clearance to do the investigation. Read that sentence again... A secret government agency has told our Justice Department that it's not allowed to investigate it. And the Justice Department just says ok and drops the whole thing. We're in some serious trouble, boys and girls."http://www.crooksandliars.com/2006/05/11.html#a8245 _____________________

BRiana: Does he have any proof?? Is the judge just supposed to take his word that those events happened to him? And where would the proof be presented? At a trial, maybe? "the judge ruled proceeding with El-Masri’s case would harm national security." Zusu: eep, I hope the abuses aren't on that scale.. but you never know. Warning: NSFW: http://www.thememoryhole.org/war/iraqis_tortured/ Briana: He's only asking for around $75k?? Geeze, what he went thru is worth millions Sarcasm does not become you. Did you read this part of the article? "The court acknowledged, however, that 'if El-Masri's allegations are true or essentially true, then all fair-minded people, including those who believe that state secrets must be protected, that this lawsuit cannot proceed, and that renditions are a necessary step to take in this war, must also agree that El-Masri has suffered injuries as a result of our country's mistake and deserves a remedy.' " UPDATE: He's taking his case to a higher court and has also claimed he is willing to settle and give up his claim for $75,000 in exchange for an apology from the CIA: http://today.reuters.com/news/newsArticle.aspx?type=domesticNews&storyID=2006-05-19T142427Z_01_N18294210_RTRUKOC_0_US-SECURITY-USA-MASRI.xml _____________________

eep, I hope the abuses aren't on that scale.. but you never know. Warning: NSFW: http://www.thememoryhole.org/war/iraqis_tortured/ During WWII (by executive order in February 1942) aproximately 120,000 ethnic Japanese american were detained for the duration of the war. At its peak (in 2004), Abu Ghraib held more than 7,000 people. The numbers have since been reduced mostly by prisoner releases. The abuses in Abu Ghraib were much worse, but the scale (i.e. number of people and the length of internment) was also much smaller/shorter. And as I said, I certainly hope that the CIA internments are not happening on the scale of the WWII Japanese internments. _____________________

Sarcasm does not become you. Did you read this part of the article? I was being serious. Being kidnapped and beaten/tortured *is* worth millions in compensation. Briana Dawson |

The Executive Branch (the CIA/NSA and other Intelligence Agencies) doesn't get to tell the Judicial Branch to butt out. Separation of powers and checks and balances and all. And anybody that tells you that we have to trash those to fight terrorism is an idiot. And that includes the Moron in Chief.

It looks to me like if we are fighting terroism we should be fighting ourselves.
