Last I heard about this, the video card makers had found a way to support GL ICDs that didn't disable Aero Glass, so it wouldn't make much difference anyway.
Bear in mind that OpenGL has been "dead" on Windows ever since Direct3D was brought in, that is, Windows itself doesn't support any higher version than what was available at that time. Fortunately GL has a good extensions mechanism that let people work around that ....
