HI there,
A while ago i hired a friend to make a sign for my store and i payed her for this, what i didnt realise is that i should have got the texture off her as well. Now i want to use this texture again for other purposes but i dont think she plays anymore as i never see her online anymore. Is there any way i can get my texture back if she is not playing SL anymore?
Also it possble for me to download this texture from SL so i can modify with photoshop, gimp etc? Or is it actually the original photoshop file that i am after?

Itchy, It depends upon whether your friend gave you the texture with 'COPY' permissions. Try this. EDIT the Sign. Click on the 'TEXTURES

Since nobody else has responded - no, there's no way you can get hold of the texture unless you have it in your inventory, unless it's set for sale somewhere, short of violating the TOS and risking your account. If you're not seeing her online, try passing her a notecard - if people are offline for a long time, their offline IMs are often capped, meaning they might not see any you send. The notecard will be in their inventory when they do log on. If she hasn't passed you the texture itself, then you have no rights to it (other than the one sign you have), regardless of any verbal agreement, so don't go using any 'alternative' means to get hold of it. Just try contacting her via IM and notecards. People can be absent from SL for any number of reasons, and it's quite possible that she'll get back to you - I wouldn't try to acquire the texture any other way, it's only risking your account.
Edit: For modifications, you'll either need a full permission copy of the texture in your inventory which you'll then be able to save to your hard drive and alter, or else (preferably, to retain image quality) have her email the photoshop file, yes.
