help me please

I paid 4800 for a new publication from a guy name Mudge McCann
it was the front cover, the inside page of that cover and two addition spots on the same page wthin.
Well cheap yes but I and my sister spent days putting together the advertisements that were first due the 21 then the 19th and latestly today. After receiving our ads he mentions branding us. Well I have been here a long time an am sure most people know my brand, I said he is not branding us when he all of a sudden demands us our money back.
Its no doubt he has a higher paying customer but what is my recourse here? Any? Please tell me what you think.

Thank you Schwanson :) but how? How can I fight it. What can I do here but post here and make sure my friends know. I am not a spiteful person. This has got me really meaner then I'm comfortable already. If it was just me I'd not have even but my sister too.

In response to the fraudulant claims by Mz Tapioca I submit the following. She paid for the ads as she states correctly to be placed in a shopping guide available at www.mudgmccann.com for free. However after receiving the ads and placing them for her and her sister Mz Tapioca began to instruct me on how my publication should work. After her explaining to me that her sister was not happy about sharing the front page with the guides logo and that she has paid some 57000L dollars this week for advertising, I in turn explained that THE LOGO I repeat THE LOGO was an identity that we are trying to establish in sl . I said that having the LOGO on the font was branding. A term whith which her sister would be familiar with as Mz Tapioca tells me over and over that she is into rl marketing. At no stage did I say anything about "branding her" a term I should think best known to cowboys. Suffice to say that after consideration of what she said I REFUNDED HER MONEYS IN FULL. To that end she has now threatend to tell my other clients that I am a cheat etc etc. here is an extract of some of that conversation after I refunded her money

So Mz tapioca I agree entirely with your topic heading.

Incidentally drop by the Mudge McCann office in Sylvata and have a look at the shopping guide. we do do glossy magazines thats left to second style another brilliant publication.

Well, I know that my ad deadline was moved up over a week because Mudge McCann informed us that other people where interested in the advertising space that we had already paid for.

I think that we all know Tequila Tapioca’s, Tapioca Tastes business has been around for a long while and she is a very accommodating and fair business women.

I don’t think any of us who know Tequila or who have done business with her can believe these allegations of Mr. Mudge McCann.

We knew the cover had logos and header and there was no such conversation but He wanted to be responsible for branding us. Even so people know me well enough. I wanted him to honor the space. He obviousely has a higher paying customer. When I told him I was a brand advertising in his rag is when he insisted getting us out. Dates chaneged he mentioned numerous times about how distraught advertiser were the space was not available. I am also not wanting a pissing match of retyped dialog here. Just how here will we dispute this sort of action?

You don't dispute it, you just write it off and exercise a little less trust in unestablished entities in the future.

Your store is well established, whatever publication you are talking about doesn't even seem to exist yet. Perhaps the worst thing you can do is spoil your good name by having a forum war.

I don't know who is right, I don't even understand what the whole issue is. But once a conflict has reached this stage, you are best off just walking away.

These are examples of unclear, gibberisheque language Mavis. I'm glad you can understand it, because I speak regular english and can't understand a bit of that.

Tapioca can't really spoil a good name she never had. I for one will never shop there now, since she slanders and libels on the forums.

Well Mr. Mudge I don’t really know what transpired between you, and yes, my RL sister. But I do know that last night the three of us had a conversation about my ad going below your publications headline on the front page.

Therefore, we all can easily and obviously see that your allegations are nothing more then a bold face lie.

You moved up our deadline up more then a week, and after we handed it in you pulled us. SL business people are not idiots.

actually i wont scuttle of, the current argument is intreging yet insted of sorting this out its turned into a 'OWWWW he pushed me!' 'no i didnt!' 'yes you did ill tell' 'yeh so ill tell that you walked infront of me which you did' :P

so wah tis teh argument point? by the looks of it a (used to be) respected buisness lady may have just dented her image by reading something wrong and starting a smear campain (which does work if you dont have your name next to it - overwise it just makes you look stupid - see 'ginko vs ansche chung' and anshe chungs massive multi forums posts)

read and reread - he said it was a brand - did he say it was to be your brand or his? was he talking about the logo or the ad? did the logo cover the ad? would help if a pic was posted for others to see whats up

EDIT:- just wanted to add mavis's post was added after i started this post so i didnt see it, mavis - you cant enter a dispute like so without saying who you are and then walk out when caught out - and 'all of us' normally means everyone reading aswell and i cant see who the lier is althou i do have a feeling

edit to edit:- just realised that sounded like a kick to mavis - sorry it was a point not a hit, plus i forgot to add the line 'as the damage that would of been to one persons name has been more than doubled and now is shared between you'

kornation in real life creates and helps run a advertising magazine with his father and has done so for the last 6 years and its still running local advertising - competitions and area information in the now 3 areas it covers - yes i do have to use a dictionary often and spellchecker too - that and i also just hand a few out to family first so they can get first look (free testing yippie!)

It disturbs me to think that this place of all places where people come to escape their real lives and all its foibles, that lies and deceit can flourish with as much consequence as the real world. To have to defends one good name because of so-called “well known identities” and the inference that they should be right because of this disgust me. If one would attend the offices of Mudge McCann 9a character of mine but not my true self) one would find that the prices are fixed for all our page layouts. That is one of our selling points that no one should have to ‘bid’ to get there wares advertised. The guide is designed for those of us who need greater exposure.
To have these two “so called well known and connected” business owners openly lie yes lie about conversations and a deadline is just beyond my expectations of this “game”. One mall owner many days ago actually emailed me disappointed that the cover had already been purchased. So for these people to say that I had offers from others for more money for the cover is false. And two that are prices are for a two week period. The deal given to these two businesses was for three weeks. That was one extra week free.
I have a habit of looking at the glass being half full as opposed to being half empty…I suppose one could say by the fuss and eagerness that these two businesses are making over being included in the guide….well we must have a pretty good publication...dont you think?

Oh man, too much. I was banned from Ms. Tapioca's mall just a couple of days ago. Why? Because I left a prim on her land. Oooh, bad 0h Mercy, BAD! Did I mention that was over a month ago? The gal sure can hold a grudge.

Here's how it went down: I walked into her shop, and politely asked if there were any animations to be found there. There were not, so I was about to leave. She suddenly twigged as to who I was, and proceeded to scold and then ban me. Not before a few unpleasant words were exchanged.

No Mudge, it's not just you. Tequila Tapioca treats everyone like that. But don't fret. Second Life needs these obnoxious people just to keep it interesting. They help us remember who the good people are. Puts it all in perspective.
