Special Covenant Provision for Marktplatz Parcels
In accordance with the Bills passed by the RA on February 1 and 8, 2006, the following Special Covenant Provision is appended to the Standard Neualtenburg Covenant. The terms contained in this Provision will apply to all parcels defined by the Neualtenburg RA as falling within the zoning area defined in that Bill, called the Marktplatz.
1. There must be a building on the parcel. The building and all signage attached to it must be in theme, and must be of high quality. The theme must be consistent with pre-1900 European artitecture such as might conceivably have been seen at that time in the Bavarian section of Germany.
2. The ground floor of the building must be devoted to commerce. Higher levels may be residential.
3. The business engaged in must be approved. The nature of the business will be reviewed every six months to assure compliance. Suitable businesses are listed in the addendum.
4. Business must be carried out. The proprietor must demonstrate some evidence of business activity if requested.
5. The Committee of the Guild will make all determinations as to whether these requirements have been met. Owners not in compliance with these terms will be notified by the Committee of the Guild. From first notification, they will have 3 months in which to return to compliance. If still not in compliance, their parcel will be reclaimed. Adverse determinations by the Committee of the Guild may be appealed according to the General
Law of Neualtenburg.
6. As with all Neualtenburg Covenant Terms, these are subject to change.
Addendum:
Guidelines for Desireable Marktplatz Businesses.
(Suggested by Frank Lardner 02/16/06.)
First, I'd look for a business that offered a long-term service best suited to advance or recurring payments, for which the buyer would depend on the seller to provide continuing support.
Second, I'd look for a business that would have some network effects, so that the value of the service would be enhanced as more people used it, reinforcing the value of the service to all users.
Third, I'd look for a business that required a relatively high degree of skill and professional attention to operate, so that it would be less vulnerable to competitive pressures.
Fourth, I'd look for a business that would benefit from branding, from confidence in origin, and that would have the potential for brand extension (the Virgin brand is a classic example).
These might include:
a) developers of advanced network systems for providing new forms of communications, transportation, games and PVP combat systems,
b) professional creators of "bespoke" environments such as highly skilled architects, designers or scripters,
c) offerors of well-founded financial and professional services such as lenders and land developers.
I would not include (except to the extent used to demonstrate systems like those above):
"retail vendors" (note: this provision is modified below) or malls
casinos, bars, coffee shops or brothels
theaters, arenas or stadiums
anything using lots of prims, scripts or other resource drains.

Retail shops will be permitted in the Marktplatz zone. However, goods sold must be of high quality and of a nature reflective of the stature of Neualtenburg.
The Committee of the Guild will provide the final determination of what qualifies and what does not. Merchants are urged to discuss plans with members of the Committee of the Guild.
