hi all

im wondering if you can tell me if this is allowed, I have some freebie t'shirts i sell on xstreet, just with my logo on them figured nice to have a freebie to give out,

in hindsight i should have been a big tighter on the perms i gave, but like all my products they are mod/trans no copy,

well i noticed 1 person buying multiple copys of the same freebee items, then looked at this person inworld store and there they are displayed at her store (also free),

however not only that but she has saved the picture from the xstreet listing to use on her board, so its my image on her display board, (taken from save image on xstreet)

even though she isnt selling the product its still a freebie, she is using my image to display the item, still with my brand logo,

i know now to give no transfer on freebie items, but if i wanted my items to be display in freebee store i would have given away as full perm, or sell as full perm,

can some1 let me know if this is all allowed, her reponse to seeing me on the sim was "dont worry we not resellers"

any advice would be appreciated thank you all

Taking the picture off slex is a bit questionable.. There's nothing 'illegal' about her passing out your trans/no-copy stuff, though.

Do you really care or are you just curious?

She has no right to use your image from XStreet. Assuming it's something for which you're the copyright owner, that would be a legitimate DMCA complaint.

As for redistributing your items, it would be difficult to argue against it.

im just curious really, so i can learn for the future, but slightly annoyed about having my stuff with my logo displayed with all other full perm noob items,
i mean its only 1 store but still i feel it cheapens my brand,

It may help your brand...think of it as free advertising.

SL has got so weird with business.. Many people pay other people to hand out their stuff with their logo on it.. In SL you want to file a DMCA against their ass. No wonder advertising doesn't work well in SL.

Lifting the image was not cool, but IMO if she's offering the freebies just the same way you are (hopefully proper perms and with a LM included) then I say it's free advertising.. go with it.

i appeciate all your comments and yeah works well for free advertising, but would be better if she didnt remove my LM from the boxes when she got them, and she asked me for a pic instead of saving off xstreet listing,
i guess on the plus side my logo/name is still on the items,
im not really flipping out over it just sort of wondered about it all, its my fault for setting the freebee items transferable, but its all learning process,

I'd just tell her that she altered the conditions by which you were giving the freebies out by removing the LM from them, and that she needs to leave the LM included or remove the items all together. That's fair.

Hmmm..her taking your Xstreet image is a bit weird. And removing your landmark..I wonder why she bothered? Otherwise, I think you should send her a vendor with a packaged set, including your landmark, and make it no-mod. ( ie, a no-mod box, with contents set for sale for 0L$) Then she can continue to have your freebie included with the others, and you also get the benefit you intended from it. Good advertising :)

I would suggest always making your free gifts no transfer. This person isn't reselling, but there are plenty of people who will resell transfer enabled freebies.

I'd wonder why she does this. If she's doing it to generate more traffic and attract customers under false association with your brand, I'd ask her to stop.

That said, I'd actually talk to her about this. If it bothers you a lot (and depending on her reaction) I'd make my freebies no trans and/or include a line that it is not intended for promotional resell purposes.

i know now to have made the freebie no trans, but all my other items are trans, and its all menswear but 90% of my customers are females buying for others, so in the future any freebies will be no perm,
As far as her wanting free association with my brand im a unknown brand, all she must do is go through all the freebie on xstreet and exploit the ones she can for her own little freebie store and she has to rerezz a object everytime someone buys one,

I would suggest making your freebies mod/copy, rather than mod/trans, if this bothers you.

Given the hassle involved in giving out no-copy stuff (you have to get the customer to buy it and then pick up the box, and most of them don't know this) I doubt the perp is going to get much interest in this.

I'd send a note card to the person (make the note card 'no modify') saying that if they like your item and wish to pass it out to newbies, (or whatever reason she's giving it out free in her shop) to let you do it yourself in her shop. (If it is group land, you and the other freebie-makers can join her group and rez your product posters or boxes there.)

It would be much easier for both of you as well as being good exposure for your product. Shops do cost tier or rent.

That's what I'd do since she's going to do it anyway - and your wish must be to help people or you wouldn't make freebies, I reckon - your mileage may vary.
