Is it a breach in LL TOS to IM someone and have a third party using one of those Collar type scripts to listen in on both ends of the conversation? I've had this happen, while the third person who was listening in was a friend and I would rather them had contacted me about it first but I still didn't mind. But is it a breach in TOS?

As I understand it, yes.

If you didn't consent to the recording, they can get in big trouble for this.

If you had been clearly warned, however, and agreed there may be less of a case.

Well I think it's a violation (I can't remember if it is TOS or CS) to disclose private information including IMs. So... I would say the person wearing the collar would be in violation. They knew it would be shared with the third person.

I'm pretty sure it would be against the TOS if it was possible.

Certainly not impossible if you have custom client software; it wouldn't surprise me in the least if that's how it worked. I hear there are custom clients that even control avatar actions remotely, and so forth.

Ah, it's not the script, it's a feature of RLV. Gotcha.

Regardless, even if it's just the guy at the other end copying the chat to the third party, it's the unauthorized transmission that's against the ToS however it's done.

I believe RLV can prevent you from reading your own IMs. It does not let others read your IMs. If I am wrong on this maybe someone can correct me.

I have heard that there are ways for others to hear/read your IM without you passing it on, but so far seen no proof of this.

RLV can let someone else have a log of your open chat or any open chat around you.
