For all I know, there may be reasons he has not spoken up about it. The piece was created primarily for his NOOBility installation, and sold at Black Swan. It was not sold full perm. I'll quote, cuz it's a long article -- but it's a good read overall. Unfortunately, what did get nicked was Art's prim-based noob. It was copybotted and free full-mod noobs became available - even via SL Exchange - all over the grid a few weeks ago. While Art filed a DMCA, he has not had a response from Linden Lab. Also, a coment by Laxness' friend, Seifert Surface, on the SL Herald site at http://foo.secondlifeherald.com/slh/2008/12/m-linden---phul.html The pictured statue is derivative of a copybotted work of art by Art Laxness. The prim noob was created by him for an installation on Rezzable's Black Swan sim, then copybotted by Stavin Carter and released as a "freebie". I'm sure there is some irony here somewhere. Surely the creator was LL, or more specifically, the person who actually designed the original 'live' noob. So any of the statues are copies!

It is possible that Linden Lab has not responded to the DMCA because they consider the noob statue to be an unauthorized derivative work of their original newbie design and AFK animation. I had no idea..... I hate supporting someone who steals.. I shall delete the noob ... (not that I used him anyway) I'm in the middle of my semi-regular update to NCI's freebies. It's becoming increasingly frustrating to maintain a collection of legal freebies, as sometimes the listed creator is not the true creator. It would certainly make things easier for me, if LL removed unauthorized rips from their database. _____________________

I've seen this particular n00b used *all* over SL, in many derivative works. Certainly I am against the use of stolen content, however most people are probably not aware that it was stolen.
I just wonder whether it makes sense to break so much content (and some very creative uses out there) by removing the ripped n00b from the database. I'm not justifying the use of the ripped n00b, but seeing all that derivative content break is disturbing too. Does that mean then, that nobody should use any part of any freebie because it could be unknowingly stolen content? |
