So I've developed this wonderful plot of land with a house & pool & many extras - all made by me with one exception - a beautiful waterfall that I purchased when I wasn't thinking about selling. The waterfall is mod/copy only.
My question is - can I sell the land with the waterfall on it? I'm not trying to claim I made it and I understand the new owners won't be able to do anything with it at all but if that was ok, is it "proper" to sell the land with the waterfall intact?

it won't sell, it belongs to you and only you, no transfer means no transfer, it's yours forever!

Well, it looks like I need to learn to build better waterfalls I was just curious because when I bought the land there were these huge prim rocks there that the landowner left. I couldn't do anything with them because she said they were no transfer. However, the land did sell with them and I would still have them if I hadn't asked her to remove them. How is that different than my waterfall?

The land sold with them on it but autoreturn would remove them. Notrans means notrans. A simple edit of the rocks would show you that you are not the owner and what the permissions are on the rocks.

I don't understand how auto-return works. The rocks that came with the land didn't auto-return. It was a few days later that I was talking to the landlady about them and she took them & told me where I could buy my own, which I did. I only wanted her to take hers because I couldn't move them myself.
I do understand that I would retain ownership and that the new owners could simply return the waterfall if they decided they didn't want it. I'm not trying to claim I made it, I'm just wondering if the waterfall would stay there if I were to sell the land? So the new owners could enjoy it if they wanted to or return it if not.

If you had set autoreturn at the time you purchased the land, anything not belonging to you or set to your group (if the land was set to a group) would have been returned to the owner. You could leave the waterfall there, but it would remain in your possession until they returned it or you came back and picked them up. Personally, I dislike this practice. It is deceptive to buyers who think they are getting pretty rocks/palm trees with the purchase.

I agree, this could be deceptive. In this circumstance I feel it's different but if I'm wrong I would appreciate some constructive criticism. I purchased a full open-sim. I've built what I feel is a very luxurious house, pool & park. The waterfall is the only item on the land I haven't built - well, actually that's not quite acurate, I didn't build the trees but they are all transferable versions. Anyway, the waterfall is kind of the center point of the park and I've done some serious landscaping around it. I was thinking that I would simply explain it fully in the covenant - the waterfall is there for your enjoyment but it was built by Perfect Prefabs Lime and is not transferable, if you do not want it simply return it - kinda thing. I would then discuss it with any prospective new buyers to be sure they understood. I am not interested in deception in any form. I just can't see this waterfall looking this good in any other setting  It cost me a fortune but I'm willing to leave it where it is because I feel it adds that much to the park. Would you consider this to be improper in any way? If so, why? I'm just trying to understand the ethics in this.

Items that are no transfer WILL stay on the land if auto-return is not enabled. Once that's done, items owned by anyone other than the landowner, will be returned.

Put in a number other than 0 for the amount of minutes something not yours/set to your group can remain on your land before being returned.

A couple of things: first, I think you can set the land for sale with "retain ownership of objects" set, and the stuff will just stay there till the buyer returns or auto-returns them. So, if you put the right words in the parcel description about the nature of this waterfall, it might not get returned to you unintentionally and the buyer may understand the constraints on it. They could even possibly add you to their landowner group temporarily, just to set the thing's group so they could turn on auto-return.
But the second thing: try not to be too surprised or disappointed when the buyer just wipes all your work. There are many visions of heaven. (On the other hand, if the result is a grid of 4x4m squares, that particular vision is of a place other than heaven.)
