I noticed alot of clothing, hats and the like using NFL, NASCAR, MLB team logos, as well as, Nike and Adidas. The NFL for example spends alot of money on their logos and don't take too kindly to having people taking them and making money off it. In the real world it's nearly impossible to have them give the okay to use them.
How do people in SL get away with it? I know it's virtual and all but people are making real money here.
I would think that the NFL would at least like their cut, as small as it might be.

I believe it is a ToS violation but it would probably take the trademark owners filing a DMCA take down order to get the Lindens to move on it.

Oh yeah there's no DMCA for trademarks so Linden Lab won't have the same safe harbor thingos. They will want to make it go away when the scary letters come in!
