I am a proud owner of an Apple 40GB iPod (dodges tomatoes :p) and have recently... dropped it. Whatever you do, do *not* drop an iPod.

I browsed over to apple.com for details on repairs, and was greeted by a long page going into detail (legal stuff) on the repair's Terms and Conditions.

I was suprised to find this:
From: someone
...Apple reserves the right to refuse repair service on products that have serial numbers altered, defaced or removed or that are damaged due to accident, abuse, neglect, misuse (including faulty installation, repair, or maintenance by anyone other than Apple or an Apple Authorized Service Provider), unauthorized modification, extreme environment (including extreme temperature or humidity), extreme physical or electrical stress or interference, fluctuation or surges of electrical power, lightning, static electricity, fire, acts of God or other external causes. In such event, Apple will return the product to you without repairing it, and may charge you the Diagnostic Fee, plus applicable sales tax...

An act of god is an external cause? :D

That's actually not uncommon!

I think when they mention God they are referring to Steve Jobs. He's known to think he is IT.

Thanks for letting us know though. I just got a 40GB on a good deal with an audio book subscription.

You will find "Acts of God" in almost all insurance policies. Just a way of covering the whole nature thing, ie. tornados, hurricanes, floods, plagues of locusts, the apocolypse, etc.

Actually, a cherub pooping in your fridge has been ruled an act of god just recently.

I have a 4g 20gb. I've heard of some people getting replacements. It is all luck. I'd suggest to head on over to http://forums.ipodlounge.com and search around for others experiences similar to your's. Good luck fellow iPodder!
