Wow, lawyers like to talk!

Really good article though.

And that intro, less than rosy account of what There is. Oh SNAP!

lol

side question came up. How many lawyers playing SL right now?

Definitely a great article. It's always interesting to read anything written about games that's actually intellectual. The regular gaming press rarely rises above the fluff level.

"Whoomp! There It Isn't!

Poor Will Harvey. He founded There, and he was the other speaker on the panel at which Philip Rosedale dropped Second Life's bombshell. Any message he was hoping to get out to the world about There was effectively lost in the Second Life hoopla."

That's freakin great! HAHAHAHAHAHAHAHA

LL got any more nukes to unleash?

Actually, I'd like to know what would happen if players in SL start suing each other like one of the scenarios in the article talks about.

Would Linden change the EULA to forbid users suing each other over IP rights?

I'm just curious if they have a response to that scenario.

I'm not yet finished with this article, but I'm loving it so far. Very well written and bringing up points that I agree with completely. I am curious too about the question you bring up Maxx. Would be interesting to know the answer!

The question that I have is is can we sue LL for losing our items from their servers? Like, a few days ago, anything built in specific servers in during that 45 minute time frame may have been lost -- can we sue for stolen property? o.O

Of course, to clarify -- I don't intend on suing anyone. But I do want to know what the Linden response would be. I hate trivial lawsuits, myself.

Section 4.3 of the terms of service seems to cover this:

From: someone
4.3 All Data Is Temporary. When using the Service, you may accumulate treasure, experience points, equipment, or other value or status indicators and contribute to the game environment ("Accumulated Status";). THIS DATA, AND ANY OTHER DATA RESIDING ON LINDEN'S SERVERS, MAY BE RESET AT ANY TIME FOR ANY OR NO REASON. ALL CHARACTER HISTORY AND DATA MAY BE ERASED IN WHICH CASE EACH CHARACTER MAY BE RESET TO NOVICE STATUS. YOU ACKNOWLEDGE THAT, NOTWITHSTANDING ANY COPYRIGHT OR OTHER RIGHTS YOU MAY HAVE WITH RESPECT TO ITEMS YOU CREATE USING THE SERVICE, ALL OF YOUR CONTENT AND ACCUMULATED STATUS HAS NO INTRINSIC CASH VALUE AND THAT LINDEN DOES NOT ENDORSE, AND EXPRESSLY DISCLAIMS (SUBJECT TO ANY UNDERLYING RIGHTS IN THE CONTENT), ANY VALUE, CASH OR OTHERWISE, ATTRIBUTED TO CONTENT OR ACCUMULATED STATUS.

5.3 B also seems relevant:
From: someone
(B) THE PERPETUAL AND IRREVOCABLE RIGHT TO DELETE ANY OR ALL OF YOUR CONTENT FROM LINDEN'S SERVERS AND FROM THE SERVICE, WHETHER INTENTIONALLY OR UNINTENTIONALLY, AND FOR ANY REASON OR NO REASON, WITHOUT ANY LIABILITY OF ANY KIND TO YOU OR ANY OTHER PARTY

A EULA is a powerful thing, but there have been successful lawsuits regarding this kind of thing. It would be cool if a Linden could give us a short confirm on this.
