Okay I did a lot of searching and could not find an answer so I thought this was the best place to ask. I am new here and I don't really want to purchase land just yet but I was wondering if there are any restrictions on selling without owning property or renting? Let's say I have a floating store and I place it over water at a certain height so as not to interfere with anyone's landscape, but only while I am online. Can I sell items like this? I could not find any restrictions on it but I just wanted to check with the community.

Technically, that land under the water is still owned by someone - and thusly the air rights are as well. Land owners can set their land to 'auto return' objects that aren't theirs at a certian time, so your build has a very high chance of not being around too long.
It's considered rude to set up shop on someone else's property - sometimes people even get irky if you -build- on thier land without their prior consent.
Your best bet is to check out the land rental and sales as well as the shopping forums - people are constantly offering free or low cost places to set up shop in malls and the like. If you go that route, you have a much lower risk of stepping on anyone's toes.

I see. I wasn't sure if the water was some kind of open space or if there was open space that nobody owned on or something like that. I found out about the returned objects thing so I knew it wouldn't stay around long but I thought it was worth a shot. If you get any kind of space somewhere do you have to pay the monthly land fee? Just like purchasing land? Or is it more like renting from an owner and paying rent in $L?

Damien, fly around and look for little boxes called Rental Cubes. You can get started setting up stalls in larger shopping areas like malls or open-air courtyards. A lot of them are setup near or around the telehubs. In these places, you can usually find very reasonable rates starting at 50 to 200 a week, depending on location.

If you rent land from someone, you only pay them, you will not have to pay a land tier fee. It's also worth mentioning that if you sign up for the $9.95/month premium membership, you not only get a stipend, you also are able to own 512m of land without incurring any land tier fees. Since you are a new user, you would also be eligible to buy "First Land" land, 512m plots of land set aside for new players to buy for L$512, very cheap. If you rent space you can just pay the land owner a weekly or monthly fee in Lindens, whatever they decide to charge and you agree to. A lot of places have it all automated now, so you actually pay your rent into a box and it keeps track of how much time is on your lease. For some places you might need to join a group and have your group tag on when you set up so your items aren't returned.
There are lots of malls and markets with spaces for rent. Try a search for them in Find.

AYe, I'd highly NOT advise to put a build on someone else's land, as it's pretty much rude... but this considered.... the idea of a "floating, nomad building" is actually quite interesting. You know... kinda like a building appearing regularly but never at the same place, so that people need to find it first if they want to see it... That'd be kinda like a treasure hunt

Thank you all for the comments. These are the things I really needed to know. As for building on someone's land, that was not really my intention. I was really thinking more of a floating vendor. Something similar to hotdog stands or vending trucks where the shop would move like Tanaquil said. I would actually like it to slowly move from sim to sim offering products while I am online. But as others stated I don't want to be rude and invade on other people's land. So I guess it won't fly, no pun intended  . But that is why I was thinking about running over the water or empty land. Thanks again.

Damien - Why don't you pin point places that you want to move to and from and then IM the owners of these places and ask them if it's ok for you to show up intermittantly and sell your wares? If someone IM'd me and told me what they were selling and how many prims etc, I would probably give them permission.
I too like the idea of a floating Vendor moving from SIM to SIM, its kind of cool.

If you need to rent a land, you can come on mine, It's in Wesport. I also rent appartments there so you just have to look for Patryk Stirling in the find place menu. Just don't put your shop too near of my appartements, and give me WHAT YOU WANT, (or nothing if you are short in L$) for the "rent". I don't use this land for now, it's for sale so I don't really need to make L$ with it. It just makes me happy to help a new resident.

Rose, that's not a bad idea at all. I may try that. And Patryk, thank you for the offer. I may consider renting from you once I get a store together. Everyone is so friendly and helpful. It's ironic that you have to go to a virtual world to meet the friendly people in life  Thank you.

You can also post your items for sale on SL Exchange without owning any land. Having your items available for purchase through the Marketplace website requires that you have at least one prim rezzed in-world at all times, but we can host this prim for you on our land if you so desire.
