As you know the availability is very limited (only 4). Not will it only provide you the perfect and exclusice home but it will also preserve your investment at all times. PLEASE read the rest of this covenant.
It is important that you understand that you will be buying the LEASE of the land and building/s that come with it. You are the owner for as long as you pay your monthly service & lease charges.
Even though rules are not always fun, they are necessary if we are to achieve a safe, fun and stress-free environment for every resident of LORIAN Estates. It is very important that you READ AND MAKE SURE YOU UNDERSTAND THIS COVENANT (AGREEMENT) BEFORE YOU PURCHASE THE LEASE ON THIS LAND! IT IS YOUR RESPONSIBLITY TO LEARN AND FOLLOW ALL TERMS LISTED BELOW. IGNORANCE OF THE RULES IS NOT A VALID EXCUSE FOR BREAKING THEM. ALL REGULATIONS AND FINANCIAL OBLIGATIONS ARE NON-NEGOTIABLE ONCE YOU ENTER INTO THIS COVENANT. SHOULD YOU IN ANY WAY FAIL TO FOLLOW THE RULES OR MEET YOUR FINANCIAL OBLIGATIONS TO LEGOLAS LUKE, YOU RISK TERMINATION YOUR RESIDENCY HERE ON LORIAN ESTATES WITHOUT REFUND. I do not want or like to have to terminate anyone’s residency. Unfortunately, it is necessary from time to time. Therefore, I want to be sure to set clear expectations for you, as a potential resident of LORIAN Estates before entering into an agreement. SO, I CAN NOT STRESS ENOUGH THAT YOU READ THIS COVENANT. IT IS FOR YOUR PROTECTION AS WELL AS OURS.
This land is on a private island and hence there are zoning regulations and financial obligations to adhere to. These regulations/ obligations are clearly stated here in this document and by purchasing the lease on this land land you agree to all the terms and conditions set forth herein and enter an agreement with Legoals Luke via LORIAN Estates.
We have preserved 1/4 of the SIM for public land that forms the communal beach for residents to enjoy themselves and hold parties etc. to their wish & requirements, without permission. This also allways you to enjoy a lag free home on this class 5 server.
You do not have the permission or right to sell your land. You may sell your lease agreement at a price of your choice. However you msut inform the new buyer that he/she will have to pay the standard lease purchase fee to Legolas Luke in order to be able to take tranfer of the lease. Plus of course the monthly service & lease charges from that moment on. Alternatively you may charge the prospective buyer a sum and pay the lease purchase fee to Legoals Luke on their behalf.
At no time are you allowed to sub-lease your land & property.

~Building Restrictions~

You are obliged to preserve and keep the building/s supplied with the land you purchase. You may NOT modify the appearance of the building/s in anyway whatsoever. You cannot build a second structure that is higher than half the hight of your building and larger than 10x10 metres in dimensions.
This is done to preserve the unique appearance of the island. It is for your benefit as it is for others.
If you fail to observe this rule your lease will be terminated without notice and you WILL NOT be entitled to any refund whatsoever.

~Events~

You can hold whatever private party/ies you wish on your land or the communal beach area. You are not allowed to display, allow or make available any explicit sexual act or behaviours on communal areas. Please keep such things in your villa.

~Security Scripts/Parcel access ~
***********************************
s-Globe is provided as standard with each land. You will be added to your land's s-Globe upon purchase. s-Globe is one of SL's most powerful and efficient security systems. You will be provided with a user guide upon purchase of land. No SL red tapes and no other security product is allowed on this island.

~Land Editing~
***********************************
You are allowed to terraform the land within reason. By "within reason" it is meant the following:
1. You cannot raise the level of the land from its current level at the time you purchased it
2. You cannot lower the level of the land from its current level at the time you purchased it
3. You can change the shape as you like
4. You are not allowed to sub-divide your land
You may shape your land however you choose, keeping in mind that the plots of land adjoin others (via a water stream). Therefore we ask that you are respectful of your neighbours by not raising your land far above theirs all the way to the property line. Basically your land and your neighbors land should run fairly smooth along the property line. You may not subdivide plots. If I see land that has been terra-formed in a way that infringes or otherwise hinders your neighbor(s) in any way, I will notify and ask you to fix it immediately (or upon your next log-in). If I do not hear from you within a reasonable amount of time, I will reclaim the land and fix it myself. I will then reset the land to sell back to you for $5000L.

~Usage~

This is a RESIDENTIAL Island only. You may not operate ANY kind of business from here. Other rules as below:
1. You may not use red tapes
2. You may not disturb your neigbours in any way whatsoever
3. You may not use rotating signs or lights outside of your villa
4. You may not use heavy lag producing scripts (we reserve the right to decide what is heavy and what's not) in any shape or form
5. You may not replace, modify or duplicate the technologies that are provided with your estate in any way
6. You or anyone on your premisses (given that they are your visitors) are not allowed to SHOUT at any time
Failing to adhere to the above terms will result in the termination of your lease WITHOUT any refund.

~Reselling Land~

You do not have the permission or right to sell your land. You may sell your lease agreement at a price of your choice. However you must inform the new buyer that he/she will have to pay the standard lease purchase fee to Legolas Luke in order to be able to take tranfer of the lease. Plus of course the monthly service & lease charges from that moment on. Alternatively you may charge the prospective buyer a sum and pay the lease purchase fee to Legolas Luke on their behalf.
Anyone who purchases the lease on your land will also have to abide by the terms set forth in this agreement. If you do decide to sell your lease, you must notify Legolas Luke so that the new resident will be able to pay their lease fee and monthly service & lease. Legoals Luke must be notified if there is a transfer of land to any account other than the account paying the tier, under which case it will be treated as sale of lease.

~ Monthly services charges and lease fees~

There are two costs to you when leasing land from LORIAN Estates:
• The INITIAL PURCHASE PRICE - This is the lease price you pay to LORIAN Estates for the land, technology and properties that come with it.
• The (monthly) service & lease fees payment - This is paid to Legolas Luke via payment boxes located on each individual land. These fees also include your tier charges. It is paid just as you would pay Linden Lab if you owned land on the main land operated by Linden Lab.

ALL SERVICE & LEASE FEE PAYMENTS MUST BE PAID INTO THE COLECTION BOXES PROVIDED JUST OUT SIDE YOUR PLOT.

• You may terminate the agreement at any time. A refund will NOT be given for any time/tier remaining on the fee collection boxes. Special circumstances will be considered but this is not guaranteed in any way whatsoever.
• If you choose to terminate your residency and do not wish to sell yourlease, LORIAN Esates will buy back the lease for half (1/2) of the original purchase price.
• Failure to make your monthly fee payments will be considered as a breach of this agreement and will result in your residency on the island being terminated, your land being reclaimed and the parcel's objects (ones that belong to you) being returned. NO REFUNDS FOR THE PURCHASE PRICE OF THE LEASE WILL BE GIVEN IF YOU FAIL TO MAKE YOUR MONTHLY FEE PAYMENTS.
• Monthly fee payments are NOT transferable to another resident.

*What is tier?*
***********************************
Tier payments are payments made to Linden Lab based on the size of the land you own. It is a maintenance fee for server space on the Linden servers. The purchase price can be looked at as a set up fee of the servers.
All residents who own land must pay a monthly fee based on the size of lot they own. If you owned land on the mainland you would be paying that tier to Linden Lab directly. On private islands, the owner of the island pays the tier to Linden Lab, so they often collect tier from their residents to cover their own tier, based on the amount of land each resident owns.
The tier is exactly the same no matter who pays it. Some island owners charge more or less depending on their cost of how much to collect in tier based on the amount of tier they pay to Linden Lab.

~Prices and Schedule of Lease and montly service & lease fees~

While I reserve the right to increase monthly fees, the fees will only be increased in the event that Linden Labs increases land fee rates or decides to place additional charges on island owners, or if the $L falls below $300 L / $1 (U.S.) on the Linden Exchange.
All parcels of land pay the same amount per 4096m² of land.
MINIMUM LEASE PERIOD IS 4 weeks, but you may pay in advance for as many weeks as you wish, up to 52 weeks.
All plots (1/16 sim):
Size - 4,096m2
Prims - 937 (minus the prim count of all objects provided with the land)
Monthly total fee - L$13,750
Purchase Price - L$25,000.

~LATE PAYMENTS~
***********************************
If you are late with your monthly fee and fail to contact Legolas Luke before your fee is due, your land will be reclaimed and access will be restricted for 7 days. If you pay within the 7 days, the land will be reset to sell to you for a late payment fee of L$4,000 for each 4096m² parcel you own. The amount of late time will be deducted from your fee collection box. If you fail to pay by the end of those 7 days, the land will be put on the market for sale and you will lose any money you have paid for the land. In addition, the amount of time you are late will not be deducted from any future fee collection box payments.

~SIM ACCESS~

Everyone has access to LORIAN Estates. Accordingly, preserving a comfortable and luxurious living environment in SL is my top priority. Therefore, I reserve the right to terminate the residency of any resident deemed to be 'griefing' another resident while in an island sim owned and operated by LORIAN Estates. This holds for the main account of the resident, any alts and/or friends of the resident. These incidents will be dealt with on a case by case basis. A refund will NOT be given for any time remaining on the fee collection boxes or for the purchase price of the lease. I DO NOT TOLERATE GREIFING IN ANY WAY! SO DON'T DO IT! AND DON'T TEST ME! We reserve the right to ban individuals from the SIM. This will not be taken lightly. Therefore, any banning will be done only after much consideration and investigation.
Lease purchases made on LORIAN Estates is intended to be an ongoing permanent agreement for as long as both parties desire. Under the extremely unlikely event that the SIM is to be sold or if SL ceases to exist, I will refund the full amount of the last fee payment, regardless of where the land owner is in their rental period.
BY BECOMING A RESIDENT / LEASED LAND OWNER, YOU ARE STATING THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THE TERMS, CONDITIONS AND GUIDELINES SET FORTH IN THIS COVENANT.
