Since when has the present Administration paid attention to federal judges when they want to keep doing something??
They simply stick some get-around into the next piece of legislature, or just keep doing whatever on the down-low.

On the one hand, I admire what they're trying to do and that they even managed to score a minor victory. On the other, I believe the efforts stem from a mistaken belief that the system can be salvaged at all, and I don't expect it to make all that much difference in the long run. Still, valiantly fought. Nobody will ever be able to say that the ACLU didn't try.
