Well I didn't know they throw food at you. I personally wouldn't go to a restaurant where they throw food at people

If someone rams their car into mine and I require surgery that ends in my demise, then yes it is the other persons fault, for I wouldn't have been in that situation if they hadn't hit me. Seems like the same kind of scenario here...

I don't really think these two scenarios are comparable. A person could be reasonably expected to know that ramming their car into yours would result in injury, this is not the the case with throwing something as light as a shrimp.
