In California (I can't comment on elsewhere), it's legal to video or audio tape anyone who is in public. In fact, it's legal to do so without their permission as long as there is not

"a reasonable expectation of privacy".

And "tampering" with the video tape? It's his property to begin with! Nobody has any right to say what he does with the tape - edit it, copy it, or take it outside and bury it in soft peat.

SOMEONE got caught with their pants down and is trying to blame the victim.
