ISP fined $5000 for hate content

"In a precedent-setting ruling, the Canadian Human Rights Tribunal has fined a hosting company for carrying 'objectionable content'. The material in question was White Supremacist postings. From the article: 'The ruling sends a very strong message that Internet servers, if they are aware there is hate content and don't take timely action to remove it, can be held liable,' said the Ottawa lawyer who filed the complaint in February 2002. The individual posters were fined thousands as well."

Well, the canadian Bill of Rights is worded a little different from the US equivilant document, but I.1.d still is pretty clear, yeah.

Unfortunatly, 318 and 319 of their criminal code throw that out the window.

Yeah, my point exactly. If it did, you might not need the government to protect you from everything.

I don't fear anyone giving me a drag-around with a pickup truck because they find out I'm gay.

I threatened no one, nor am I paranoid, because I know of no one who is planning to drag me behind a pickup truck, nor do I think anyone is going to try in the future.

Were that to change, however, it would cease to be a threat of any sort, particularly an empty one, and I would be the better off for a resonable level of precaution.

In any event, do you honestly consider saying "Trying to kill me might not be healthy for you" a threat? I'd be more concerned about the person trying to do the killing, myself...

Besides, do you worry about 'empty threats' as a matter of course? No wonder the government has to protect you from having your feelings hurt. :p :D

You seem to imply that you don't worry because it can't happen under your legal system. Not that you don't worry in general.

If you don't worry in general, then I guess your legal system is wasting it's time and needlessly restricting the freedoms of your citizens.

Can I ask how final is the "Canadian Human Rights Tribunal"'s say on the matter? I'm guessing this will be appealed to a Canadian appeals court or supreme court?
