Read the description of the linked item. The spam is done by the 'bullet' options.

Ah, but remember, it's not the sick mind that creates the weapon that's to blame - it's the sick people that buy it and use it.

From experience, I'd say LL's policy is pretty much that - you can create whatever you like, even if its only function knowingly and deliberately violates the ToS. You can offer it for sale and say as much. Or not. It's using it that will get you into trouble.

I suppose there's a certain logic in that. You don't blame Colt when someone goes and puts a bullet in someone's head.

That said, there's also a certain logic in policing this kind of content at a creator level, because it has absolutely no other use than griefing, and they'd save themselves a lot of future trouble dealing with individual instances of abuse if they did something now.

That said, if LL can get away with not doing something, they surely will!
